TERMS AND CONDITIONS OF eBikes Rethymno TOURS & RENTALS

This document defines the general Terms and Conditions of the services offered by eBikes Rethymno on its site which consists of :
the execution of guided tours on electric bicycles are supervised by a tour guide at a predefined route allowing the Client to discover
• the city of Rethymno. The tours are narrated in English.
• the sole/single service of an electric bike rent in predefined rental packages.

1. GENERAL STATEMENT
1.1 The Terms and Conditions are applicable to all services sold by eBikes Rethymno through its site, including the case that the Client
did not make the booking himself.
1.2 The booking’s validation and the use of all services that are provided on this site means the complete and unconditional
acceptance of these Terms and Conditions that are included in this document.

2. RENTAL TERMS:
Special terms apply at E-BIKE RENTAL PACKAGES offered by eBikes Rethymno
2.1 eBikes Rethymno provides the Client with an electric bicycle and the necessary equipment:
2.1.1 a bike lock
2.1.2 a bicycle helmet
2.1.3 an e-bike battery charger input of 220/240V
2.2 Client should be skilled for cycling.
2.2.1 The bicycle can be used by a person taller than 1.50m.
2.2.2 eBikes Rethymno is entitled to refuse PREPAID rental (or participation to any of its tours) to the Client, if the authorised staff
dictates not sufficient cycling ability of the Client.
2.3 E-bikes provided by eBikes Rethymno are new and in excellent condition. Any technical defects that are noticed by the Client at
the pick-up or during the rental period must be mentioned directly to eBikes Rethymno
2.4 E-bike must be parked at central places or parking areas and always locked when not in
use. Parking is not allowed under traffic lights, by park-meters or traffic signs, walkways, fire
exits, house doors or in front of vehicles that may occur fines.
In case of multi-day rental the client is obligated to park the bicycle in a covered and controlled area under his diligence and expense.
2.5 The bicycle and all its components must be returned to the agreed date and time. The return
of the bicycle beyond the prepaid time has an extra charge of the Client in accordance
with the Drop-off Delay policy.
In case of infringement the present Terms and Conditions there will be extra charges.
2.6 Rental of electric bicycle is prohibited to minors under 18 unless the minor is at least 15
years old and is accompanied by an adult, who undertakes and accepts in writing the supervision and takes the whole responsibility
for his actions.
2.7 the client undertakes full replacement of the bike cost or the cost of the accessory in case of steal/theft, loss or damages during
use by the Client.
2.8 eBikes Rethymno may provide the Client with accessories upon his request as long as they are available under an extra Fee,
described on Accessories board.
2.9 eBikes Rethymno prohibits the participation of Client with the rented e-bike in cycling races or exhibitions, games and other
events. eBikes Rethymno has selected the specific model for it’s features as an exclusive asphalt road commuter, therefore is
prohibited the off road use of the bicycle.
2.10 It is prohibited the subletting and use of e-bike under the influence of drugs or alcohol and the use under a strong wind or
storm. The client is obligated to follow the Traffic Rules and conform to the road signs and general traffic ethics.
2.11 the Client is not allowed to ride without hands on the handle bar or performing dangerous actions for himself or the public.
2.12 the transfer of another person is prohibited except for minors, provided that they are acting according to the security
specifications, about the special seats or the additional components, supplied exclusively by eBikes Rethymno with extra charges.
2.13 It is also prohibited to transfer components and objects, flammable, explosive, toxic or hazardous materials and overload the
bicycle (maximum load capacity included the rider is 110/130 kg, considering that the rear’s racks maximum load is 25kg and handle
bar’s basket max 14kg.
2.14 In case of a sole/single e-bike rental (not an e bike pre arranged tours), an amount of euro 350/500 must be paid in advance as
guarantee for the observance of these terms. This amount will be released/refunded by the return of the bike and in case that the
Client has complied with terms of this contract and there is no reason of compensation for damages or losses for the bike and its
fittings, otherwise all or part of the deposit will be set of by eBikes Rethymno.
2.15 It is also prohibited every art of changes (parts and fittings) on the bicycle and the accessories that are provided by eBikes
Rethymno.

3. CHANGES TO SERVICES
eBikes Rethymno reserves the right to make any modification or improvement which are necessary or useful to its services.

4. BOOKING
4.1 The booking of a service is possible upon according the tables showed on this site.
4.2 To check out a booking, Client must go to the page on the site referred to the reservations and follow the steps as instructed.
4.3 The Client can terminate the reservation at any point before payment.

5. PAYMENT
5.1 The Client pays by :
5.1.1 CREDIT/DEBIT CARD. There is no charge or service fee for processing credit/debit
card payments
5.1.2 PAYPAL ACCOUNT
5.1.3 Deposit in bank account at the Bank ALPHA BANK

5.1.4 Cash at sales point (not for pre-booked services)
5.2 By providing his credit/debit card details the Client authorises eBikes Rethymno to debit the total amount of the booking or to
charge his credit/debit card with all the fees, extra charges and damages he causes to eBikes Rethymno or third persons.
5.3 eBikes Rethymno has employed all mechanisms to ensure the confidentiality and security of the information entered on the site
according the law and the bank regulations and conditions.

6. CANCELLATION AND REIMBURSEMENT
6.1 Cancellation of the booking by the Client
6.1.1 If the Client wants to cancel the booking he must inform ebikes rethymno earlier than 72 hours before the start of the
reserved service, by email to the address : info@ebikesrethymno.com or by telephone : (+30) 28313 01983
6.1.2. All cancellations done in less than 72 hours before the day and the hour of a reserved service will not be accepted by eBikes
Rethymno and will not be reimbursed.
6.1.3 There will be no reimbursement or compensation for partial or total abandonment of a service or non-show by the Client.
6.2 Cancellation of a service by eBikes Rethymno
6.2.1 eBikes Rethymno reserves the right to effectuate or to cancel the reserved service, if it deems it to be in the interest and
safety of the participants.
6.2.2 If eBikes Rethymno cancels a service the total amount paid by the Client will be reimbursed.
6.2.3 eBikes Rethymno will reimburse either the part or the total of the amount paid for the service, if a service is cancelled after
having started; the amount will be decided by eBikes Rethymno.
6.3 Reimbursement of the Client will be made within 30 days or within a reasonable period of time of the cancellation by bank
transfer according to the booking prices and in euros.

7. THE PRICE
7.1 The price of services offered by eBikes Rethymno is those which appears on the site on the date of the booking.
7.2 The prices are in euros and include taxes.

8. CONDITIONS OF THE CONTRACT
8.1. Proper Documentation :
8.1.1 On the day of the tour Client must show/display his ID or PASSPORT or DRIVER’S LICENCE or INSURANCE CARD in order to sign
the contract. A draft of this contract is attached on the site
8.1.2 Client should bring along/adduct either a PRINTED copy or a READABLE FILE at his smartphone of his Voucher
8.2. Proof
The data that are recorded by eBikes Rethymno at its computer systems, constitutes the proof of all transactions between eBikes
Rethymno and the Client, unless the parties can prove to the contrary.
8.3 The Tour
The meeting point is at our office in Rethymno, at 1 Panepistimiou Kritis street (Europe Center).
The Client must be at the meeting point at least 15 minutes before the departure time of the tour.
Clients with children on child seat or trailer should arrive at our office even earlier.
The times indicated on the booking confirmation must be respected.
Late arrivals to the meeting point may cause the cancellation of the tour without reimbursement or compensation.
8.4 The tour Guide
The tour guide will repeat you the safety regulations you have read here, give you the safety equipment and explain how the electric
bicycle functions before the tour starts.
The tour guide will decide the pace of the tour, the breaks and the hole route of the tour, all of which will be adapted to the
capabilities of the participants.
The tour guide reserves the right to cancel or terminate the tour or to change the route if he considers it necessary in the interest and
safety of the participants.
8.5 Rules of participation
8.5.1 The Client agrees to use the electric bicycle in a safe and careful manner.
8.5.2.The Client certifies to be capable of using an electric bicycle and to be physically/ fit enough to do so and declares that he is in
good health.
8.5.3. The Client may not leave the group unless he has the approval/permission of the tour guide .
8.5.4 The Client is responsible for his behaviour on public roads and off them. eBikes Rethymno will not be held responsible for
accidents caused by the Client or a third party during the tour.
8.5.5 The Client is responsible for the electric bicycle and all the accessories provided to him.
8.5.6 The Client agrees to return the e-bike at the place it was taken from (eBikes Rethymno office) and in the same good condition.

9. LIABILITY, SAFETY RULES AND INSURANCE
9.1 eBikes Rethymno provides a well-functioning electric bicycle which receives regular maintenance and which complies with the
current safety regulations.
9.2 At the beginning of the guided tour, the guide will explain the safety regulations and Client declares, that he abides by them.
9.3 The Client alone is in charge of the electric bicycle he is using and he is solely responsible for any injury he may inflict on a third
person or another participant during the tour. the Client undertakes the hole responsibility of paying any fines or charges relatively
by his actions/behaviour during the tour
9.4 The parents or the legal guardians of a minor participating in the tour are held full responsible for all injury caused by the latter
during the tour
9.5 eBikes Rethymno can not be held responsible for any damages or injuries incurred by the Client during the visit.
9.6 The Client is informed that he must have third-party insurance that covers him for any accident or injury occurring during the visit
and that covers him special for bicycle use.
9.7 eBikes Rethymno is not at fault, if a Client has not a third-party insurance.
9.8 Traffic Rules
The Greek Traffic Rules overlook cyclists and do not contain special traffic signals to regulate the movement/use of bicycles. In every
case, till there is a special regulation the user of a bicycle must follow the general rules such as:
In red light, never stop beside a car but either in front or behind it, so that you can be seen.
Maintain/keep a safe distance 1 to 1.5 meter when you move next to parked cars and check if they have passengers. Doors can open
suddenly .
Do not cycle on sidewalks. Take extra care, when you get off to cross the road, vehicles turning probably won’t see you .
Use the mirror. It will help you know what is happening at any moment behind and around you.
Avoid roads with heavy traffic.
Do not move in the opposite direction.
Follow the instructions of the traffic policemen

10. LOSS, THEFT AND DAMAGE TO THE BICYCLE
10.1 The Client is responsible for any loss, theft or damage to the electric bicycle and the accessories which have been provided to
him and agrees to monetarily compensate eBikes Rethymno.
10.2 The list of amounts payable can be found below and includes the following :
* according to the updated price list of the manufacturer or authorised dealer that eBikes Rethymno uses as suppliers for bikes and
parts.
10.3 The Client declares to be aware of this list and agrees to pay the predetermined charges and authorises eBikes Rethymno to
withdraw from his account the correct amount for the damages occurred, based on the above list. In that case eBikes Rethymno
must sent him via email, fax or post a copy of the invoice.

12. PICK-UP & DROP-OFF
12.1 Collection and delivery of the bicycle, for either tour or rental service is always at the office of eBikes Rethymno except
otherwise is agreed.
12.2 A full check of the bicycle take place by both parties - eBikes Rethymno and Client – at the beginning and at the end of each
service, by signing the contract.
12.3 The electric bike must be returned clean and dry, if not a 5 euro cleaning fee will be charged. DO NOT use high pressure water to
clean the electric bike.

13. DELAY TO DROP-OFF A RENTED E-BIKE
13.1. Please check our Rental Terms & Conditions in our Online Booking
13.2 The Client authorises eBikes Rethymno to charge the corresponded amount due to delay on his credit card.
13.3 eBikes Rethymno will not refund any amount if the bicycle is returned earlier than the agreed time on the rental contract.

14. CONFIDENTIALITY AND SECURITY OF DATA
14.1 All data collected from the Client is processed only in order to create an account and to make the bookings (this includes the
Client access and contributions to different pages on the site ).
14.2 The Client can also, for legitimate reasons, oppose the processing of his personal data for further use such as statistics or
advertisements . When creating his customer account on the site the Client will have the possibility to choose whether he wishes to
receive advertisements from eBikes Rethymno or any of its partners.

15. AUTHORISATION TO PUBLISH PHOTOGRAPHS
15.1The Client knows and agrees that the photographs, taken by ebikes rethymno during the tour can be published by eBikes
Rethymno on its website and on other social networks sites such as Facebook, Instagram, Twitter etc. for promotional purposes.
15.2 A Client who wishes not to appear to the photographs published by eBikes Rethymno on the website must inform eBikes
Rethymno before the tour by email to the following address : info@ebikesrethymno.com, or writing it on the contract.

16. CONFLICT, JURISDICTION AND APPLICABLE LAW
16.1 All of the above Terms and Conditions are interpreted and applied by Greek law.
16.2 The interpretation of these Terms and Conditions in the case of a contestation of the meaning of any of the above will be in
Greek. The Greek text prevails over all other translations in the case of any legal action.
16.3 For any litigation relating to the present terms and conditions the applicable law is the Greek law and the courts of Crete are
competent.
16.4 Waiver by either party or any breach of any Term or Condition in this document shall not be considered to be a waiver of any
subsequent breach of the same or any other term or condition.
16.5 The potential nullification of any of the clauses found in this contract shall not affect the validity of other provisions, such
clauses will be considered not to have been written.
16.6 The numbered titles in this document are considered only as descriptions. In the case of there being any confusion between a
title and one of the clauses of the Terms and Conditions, the titles will be deemed null and void.
